The defendant, a teller in a federally insured bank, was found guilty by a jury of making a false entry in the records of the bank with intent to injure and defraud the bank. 18 U.S.C. § 1005. Specifically, he withdrew $800 from the bank leaving in the drawer of his "bus" a check drawn upon his wife's account in the same amount, but "settling his accounts" so as not to indicate the withdrawal.
