Thurmond Price (hereafter Price or plaintiff) sued Norwood Lowman and International Business Machines Corporation in a South Carolina state court for injuries suffered when he was struck by Lowman's automobile on October 11, 1963. Based on diversity of citizenship the action was removed by the defendants to the federal district court, at Columbia, South Carolina.
