Keith Milton Rhinehart, defendant (appellant), was charged with sodomy in that he "did carnally know one James Guy Miller, a living human being and a male person, with the mouth and tongue;...." RCW 9.79.100. He was found guilty as charged at the conclusion of a jury trial. Judgment and sentence was entered upon the jury verdict.
