OPINION

DIMOND, Justice.

Appellant commenced this action on October 9, 1962, seeking damages for approximately $100,000 for an alleged breach of contract. In its answer to appellant's amended complaint, appellee stated a counterclaim against appellant in excess of $35,000.

After two previous trial settings had been vacated, the case came on for trial on January 12, 1965. Appellee was represented by its counsel...
