This is an appeal from a judgment of the Superior Court of Kern County directing appellants, the City of Bakersfield and the Pension Board of the Fireman's Disability and Retirement Fund of such city, to reinstate, retroactively from March 6, 1963, the disability retirement pension of the petitioner, James O. Pathe, respondent herein, for disability incurred by respondent in the course of the performance of his duty as a fireman.
