Judgment insofar as it dismissed plaintiff's action for injunctive relief affirmed; otherwise judgment reversed on the law and facts and case remitted to Erie Trial Term for further proceedings in accordance with the Memorandum, without costs of this appeal to either party. Certain findings of fact disapproved and reversed and new findings made.
