Petitioner is now detained in the Virginia State Penitentiary pursuant to a judgment of the Circuit Court of Nelson County entered on July 3, 1963. At that time he was sentenced on two charges— one for the statutory rape of a thirteen year old girl and one for the attempted statutory rape of an eleven year old girl, the older girl's sister.
