Robert Davis brought suit for the dissolution of a partnership and equal distribution of its assets. The defendant, James Davis (who is no relation to Robert), contended that the association was a limited partnership and that Robert was entitled only to the return of his original investment, his undistributed share of profits, and interest thereon.
