Plaintiff brought an action in the common pleas court in the city of Detroit in 1964, claiming that defendant bank improperly paid 2 of plaintiff's checks totaling $1,200. Upon completion of plaintiff's proofs defendant made a motion for a directed verdict of no cause of action which was granted. Plaintiff moved for a new trial which was denied.
