Rosalio B. Montez, then being represented by appointed counsel, was, after trial, found guilty in August, 1959, of four charges of robbery and one of attempted robbery. The evidence at the trial established that he had severely pistol-whipped his victims in an effort to intimidate them, and that he had a criminal record which included a felony conviction.
