Frank Hoy was convicted of first degree murder (K.S.A. 21-401). A jury imposed a penalty of life imprisonment (K.S.A. 21-403). The motion for new trial was denied and defendant appeals.

The charge grew out of the shooting and death of Sharon Hoy on July 8, 1965, in the first hour after midnight in the city of Wichita, Kansas. Sharon Hoy obtained a divorce...
