This is an action for damages resulting from the death of James Columbus Graham, Jr., who was fatally injured when he fell in an elevated water storage tank belonging to the City of Beaumont. Plaintiffs are the surviving wife and children of the deceased. Defendant, City of Beaumont, sought indemnity and contribution from Texas Tower and Construction Company, who was Graham's employer.
