This appeal involves a determination of the validity of the appointment of G. Dennis Thurston, the appellee, as Clerk of the Circuit Court for Washington County in the place of G. Merlin Snyder, deceased.

The facts are not in dispute. G. Merlin Snyder was re-elected Clerk of the Circuit Court for Washington County for a term of four years at the General Election held on November 8, 1966, having defeated the appellee...
