All the defendants herein have been charged with violating subdivision 6 of section 381 of the New York State Vehicle and Traffic Law, which makes it unlawful "for any person to operate or ride upon a motorcycle unless he wears a protective helmet of a type approved by the commissioner". Each defendant entered a plea of "Not guilty" on the ground that the law in question is unconstitutional...
