RATTIGAN, J.

Action for damages for assault and battery committed by appellant B. Haynes while acting in the course and scope of his employment as a police officer of appellant city. After a nonjury trial, the court entered judgment against the city and Haynes in the amount of $12,000 in compensatory damages and against Haynes alone in the amount of $5,000 as exemplary damages. Both appeal from the judgment.
