Bridesburg Corporation has instituted an action in assumpsit against the Township of Whitehall for the refund of a tax levied and collected in pursuance of Township Ordinance No. 802 imposing a tax upon the privilege of transferring for value by deed title to real property situate in the township. Defendant's preliminary objection in the nature of a demurrer is before us.
