This is an appeal by the City of Kansas City, Missouri from the action of the Circuit Court of Jackson County discharging respondent on two charges of selling cigarettes without a tax stamp thereon evidencing payment of the City cigarette tax. The two charges originated in the Municipal Court of Kansas City, Missouri, and on appeal, were tried together in the Circuit Court sitting without a jury.
