Charlie C. Hawkins was convicted of murder in the first degree without recommendation to mercy for the murder of John Marvin Tapp, an oil station attendant, during the commission of a robbery in which the defendant and another person participated. The appellant was sentenced to death. Hawkins and one Willie James Whitworth were jointly indicted for the offense.
