This is an appeal from the order of the Court of Common Pleas of Erie County, granting a new trial to the defendant-appellee, William L. Patterson, in an action of assumpsit, which resulted in a jury verdict in favor of the plaintiff-appellant, Max S. Schneider, in the amount of $3002.95.
