This day came again the parties, by counsel, and the court having maturely considered the transcript of the record of the decree aforesaid and arguments of counsel, and being equally divided as to the judgment to be entered in the premises, it is considered that the said decree be affirmed, and that the appellant pay to the appellee thirty dollars damages, and also her costs by her expended about her defense herein.
