The petition of plaintiff-appellant was filed in the Circuit Court of Dunklin County to condemn the interests and rights of Bert Shelton et al. in certain lands for a limited access highway. Condemnation was adjudged and the sufficiency thereof is not questioned. The commissioners' award of $17,000 was paid to Bert Shelton on September 12, 1963.
