OPINION BY MR. CHIEF JUSTICE BELL, January 4, 1967:

John Cunningham was indicted for murder and voluntary manslaughter. At his trial he was represented by a Court-appointed attorney. He pleaded not guilty and was tried by a Judge and jury. On June 28, 1963, the jury returned a verdict of guilty of murder in the second degree. Defendant filed a motion for a new trial, which was refused. On October 11, 1963, defendant was sentenced...
