The defendant has appealed from his conviction of murder in the second degree.

His estranged wife was living separate and apart from him. She was working a late shift for an ambulance company in Everett. On October 24, 1964, she had parked her automobile across the street from her place of employment, where she habitually left it during working hours. It had been seen parked there at 8:30 and 9:30 that evening...
