Appellant, Ernest Ray Sheldon, and his codefendant, Ashenbrenner, were charged by information with violating section 11501 of the Health and Safety Code (sale of heroin). Both men were also charged in a separate information with violating section 11531 of the Health and Safety Code (sale or furnishing of marijuana) and section 11530.5 of the Health and Safety Code (possession of marijuana for sale).
