The applicant was convicted of first degree murder by Judge Dulany Foster on February 3, 1961. A motion for new trial was filed on the same day. On February 5, 1962,1 the motion was withdrawn, the verdict of guilty of first degree murder was stricken out, a verdict of guilty of second degree...
