The only issue raised by the defendant is whether the plaintiff filed a proper claim within the nine months from the date of shipment or within nine months after a reasonable time for delivery has elapsed as required by the stipulation on the bill of lading. If such a claim was not filed, plaintiff's right of recovery would have to be denied.
