Defendant appeals from an adverse summary judgment in a replevin action. The property which was the subject matter of this possessory action was two stock certificates evidencing two hundred shares in Colorado Milling and Elevator Company.

The real contest as to right of possession is between the appellee bank who lent appellant's customer, one Riechmann, the money to pay for the stock and an out-of-state broker, Carl M. Loeb, Rhoades and Company...
