In the early part of September, 1963, Mr. Hoyt C. Newman, one of the defendants herein, contacted Mrs. Gloria Gelpi, a licensed real estate agent and an employee of the firm of Maher & Sharkey, Inc., a real estate agency, and requested that she furnish him with some information relative to a house which he was interested in purchasing.
