Recovery was first sought against the Department of Highways alone in an action filed May 15, 1963, but, by an amended petition filed September 18, 1963, Yuba Consolidated Industries, Inc., hereafter referred to as "Yuba," the construction contractor, was also impleaded as a defendant...
