This is a proceeding under the Post Conviction Act, sections 29-3001 to 29-3004, R.S.Supp., 1965. Petitioner, Gilbert Sagaser, hereinafter referred to as defendant was convicted of second degree arson growing out of a fire at the Nebraska State Penitentiary, August 16, 1955.
