This controversy arose in probate in the Matter of the Estate of Floyd J. Malli, deceased. In the trial court it was tried as a law action and has been so presented on appeal. It involves a claimed common law marriage. Because of the way the issues arose the parents of decedent were applicants and Leona Howe was respondent.
