FITZGERALD, J.

Defendant was charged with the crime of rape under CLS 1961, § 750.520 (Stat Ann 1954 Rev § 28.788). Following jury trial in which defendant was represented by retained counsel, he was found guilty. Defendant, with new counsel, filed a motion for a new trial which was denied by the court and appeal followed.
