Defendant below appeals from a judgment of $5,000 damages in favor of plaintiff who had brought an action under the Federal Employers' Liability Act. A motion for a new trial was overruled.

The cause was submitted to the jury on two counts. Count One alleged that the injuries resulted from the negligence of the railroad in allowing pulpwood to remain in a walkway between tracks 16 and 17 in Sibert...
