Two indictments were returned against the defendant, each containing two counts. Count I of the first indictment charged that Louis Ruiz, a person of 17 years and upwards, committed the offense of indecent liberties with a child, in that he performed an act of sexual intercourse with Barbara Parks, a child under the age of 16 years.
