This is an appeal from a judgment of conviction obtained in the Pulaski Circuit Court against the appellants Widup, Shidler and Mayer.

The State of Indiana has requested that this court dismiss this appeal as to the appellant Wallace Morgan for the reason that he has been improperly joined as a party; that nothing in the transcript discloses that he is a proper party; that the motion for new trial upon which the assignment of error is addressed...
