[1] This is an appeal by the State from orders of the Circuit Court of the 18th Judicial Circuit, DuPage County, that dismissed a three-count indictment against the defendant, Vernon Rinks. Although no reply brief has been filed with this court by Rinks we will consider the appeal on its merits as is within our discretion. People v. Sanders,
