This appeal by W. M. Lewis, executor of the estate of Elizabeth Hunt Overbey, deceased, resulted from the entry of a judgment in accordance with a jury verdict holding, among other things, that Mrs. Overbey died intestate on June 14, 1964.

On June 16, 1964, a paper writing bearing date of October 8, 1962, purporting to be the last will and testament of Mrs. Overbey was admitted to probate by the Clerk of the Circuit Court of Halifax County...
