This action is brought under section 1951 of the Real Property Actions and Proceedings Law, formerly section 346 of the Real Property Law, for declaratory relief extinguishing certain old tract restrictions imposed in 1912 on property in the Town of Brighton, Monroe County, New York. The parcel involved herein is a part of a larger tract known as Highland Grove.
