I'ANSON, Justice.

On March 9, 1965, Green Motor Lines, Inc. (Green), filed in the court below an application under Code § 58-1130, as amended, for the correction of erroneous assessments of motor vehicle license "taxes" for 1964 and for a refund of $5,086, the amount paid. After hearing evidence, the trial court entered judgment for Green in the amount of the refund claimed, and the Commonwealth is here on a writ of error to the judgment.
