This is an action against an automobile manufacturer to recover for personal injuries and property damage sustained in a car collision. It is claimed that the collision resulted from negligence in the design and manufacture of the car owned and operated by the plaintiff Fernand McNally and by breach of an implied warranty of the car's fitness for use. At the trial, the defendant rested on plaintiffs' case.
