Decedent died on May 5, 1966, intestate. He was survived by his widow, Marie (Petroni) Cutone, petitioner herein, and a son and daughter who were children of a prior marriage. Decedent and his wife were married on May 4, 1957.
On April 26, 1957, they entered into an antenuptial agreement which provided as follows, insofar as here relevant:
". . . it is the intention of the intended wife to waive, relinquish and bar...
