Maletz with directions to make his recommendation for conclusions of law on defendant's motion to dismiss and plaintiff's plea for judgment on the pleadings. The commissioner has done so in a report and opinion filed on November 30, 1966. The case has been submitted to the court on the briefs of the parties without oral argument of counsel.
