TENNEY, District Judge.

On October 14, 1965, this Court heard oral argument on defendant's motion to dismiss the instant indictment on the ground that he had been denied his right to a speedy trial as guaranteed by the sixth amendment. Said motion was denied since no prejudice was shown and the case proceeded to trial on that same day before this Court sitting without a jury.
