Briefly stated, the facts as they appear in the record, disclose that on the evening of the 28th day of February, 1950, Carl Goldsberry was found unconscious on the floor of his workshop located in the back of his appliance store in the 500 block of North Washington, Enid, Oklahoma, in a pool of blood and that he was removed to the hospital where he expired without regaining consciousness.
