This action was instituted on February 23, 1966, when the plaintiff, Walter Foltz, filed his complaint against Harding Glass Company, a division of Fourco Glass Company, (hereinafter referred to as Harding), the Window Glass Cutters League of America (hereinafter referred to as the League), and Robert Kymer, President of Local #7 of the League.
