Ralph Burk Shaddox was charged with the offense of assault with intent to kill, the Information charging that Shaddox shot Johnny Younes on August 9, 1966, in Boone County, with the intention of killing Younes. On trial, the jury returned a verdict of guilty, and fixed appellant's punishment at five years imprisonment in the State Penitentiary. From the judgment so entered, Shaddox brings this appeal.
