OPINION

HUMPHREYS, Justice.

Liming was convicted of unlawfully carrying a pistol and sentenced to ninety days in jail and fined fifty dollars. He has appealed and assigned errors. We need notice only two: One on the charge to the jury which we think requires a reversal for a new trial, and another which raises a search and seizure question which must be settled. These assignments are:
