MEREDITH, District Judge.

This case is pending on petitioner's application for a writ of habeas corpus and a request for an evidentiary hearing in connection therewith. This Court has jurisdiction under 28 U.S.C. § 2255.

Petitioner was indicted on two counts (violation of 26 U.S.C. § 4724(b) and of 21 U.S.C. § 174), tried by a jury, and convicted on both counts on January 16, 1964. He was sentenced to ten years on each count...
