Plaintiff Qualls sued defendant Miller for damages for personal injuries sustained by Qualls on Jan. 14, 1964, when his automobile was struck from the rear by an automobile operated by Miller. The case was tried to a jury. The jury convicted defendant Miller of negligence in causing the collision and found that such negligence was the proximate cause of such collision.
