Fred L. Ewton and wife sued Freddie R. Jackson for personal injuries sustained when Jackson's car struck the rear of the automobile driven by Fred Ewton. Trial was to a jury which found the defendant Jackson negligent, but convicted Ewton of contributory negligence. The trial court, however, rendered judgment for the plaintiffs Ewton notwithstanding the verdict. The Court of Civil Appeals sitting at Dallas, feeling that the case had not been fully...
